Terms of Service

These Terms of Service ("Terms") govern your use of the LoyalKaa platform operated by LoyalKaa ("we", "our", or "us"). By accessing or using our services, you agree to be bound by these Terms.

1. Service Description

LoyalKaa provides a digital loyalty program platform that enables businesses to create and manage loyalty cards, campaigns, and customer engagement programs. Our services include digital wallet integration (Apple Wallet, Google Wallet), QR-based transactions, automated campaigns, and real-time analytics.

2. Account Registration

To use our services, you must create an account and provide accurate information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.

You must be at least 18 years old and have the legal authority to bind your business to these Terms.

3. Acceptable Use

You agree not to:

  • Use our services for any unlawful purpose
  • Collect customer data without proper consent or in violation of applicable privacy laws
  • Attempt to access other users' data or bypass security measures
  • Interfere with the proper functioning of the platform
  • Use automated tools to scrape or extract data from our platform
  • Resell, sublicense, or redistribute our services without written permission
  • Send spam or unsolicited messages through our notification system

4. Data Ownership

You retain full ownership of your business data and customer data. We do not sell, share, or use your data for purposes other than providing our services to you. You may export your data at any time using the platform's built-in export features.

You are responsible for ensuring that your collection and use of customer data complies with all applicable privacy laws and regulations.

5. Subscription & Payment

LoyalKaa offers a 14-day free trial with full access to all features. After the trial period, continued use requires an active paid subscription. Subscription fees are billed monthly or annually as selected during sign-up.

All payments are processed securely through Stripe. We do not store your credit card information. Refunds are handled on a case-by-case basis within 14 days of payment.

6. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice. We are not liable for downtime caused by circumstances beyond our reasonable control.

7. Intellectual Property

The LoyalKaa platform, including its design, code, logos, and documentation, is our intellectual property. Your subscription grants you a non-exclusive, non-transferable license to use our services for your business operations during the subscription term.

You retain all rights to your brand assets (logos, colors, names) that you upload to customize your loyalty cards.

8. Limitation of Liability

To the maximum extent permitted by law, LoyalKaa shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of our services.

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Termination

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access until the end of your current billing period.

We may suspend or terminate your account if you violate these Terms, with notice where practicable. Upon termination, your data will be retained for 30 days to allow export, after which it will be deleted.

10. Indemnification

You agree to indemnify and hold LoyalKaa harmless from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any third-party rights.

11. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or platform notification at least 30 days before they take effect. Continued use after changes become effective constitutes acceptance.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which LoyalKaa operates, without regard to conflict of law principles.
